In order to comply with international requirements and, in particular, with the rules for granting Therapeutic Use Exemptions adopted within the framework of the UNESCO International Convention against Doping in Sport, within the scope of the Anti-Doping Convention, the Higher Sports Council has approved the new list of prohibited substances and methods in sport contained in the Resolution of December 17, 2015, which comes into force on January 1, 2016.
This Resolution applies to doping control procedures in sport carried out in official state competitions or, outside of them, to athletes licensed to participate in such competitions.
Article 4 of Organic Law 3/2013, of June 20, on the protection of health and the fight against doping in sport, establishes the obligation of the Higher Sports Council to publish in the Official State Gazette (Boletín Oficial del Estado), by means of a Resolution of its Presidency, the list of substances and methods prohibited in sport when changes are introduced to it. Likewise, the aforementioned article stipulates that this publication will be carried out within the framework of the international commitments and obligations assumed by Spain, and in particular within the framework of the UNESCO Anti-Doping Convention.
In accordance with the specific procedure of Article 34 of the International Convention against Doping in Sport, done at Paris on 18 November 2005 (published in the "Official State Gazette" of 16 February 2007), the Conference of the Parties to the Convention has approved the amendment to Annex I, the list of substances and methods prohibited in sport.
Consequently, and in order to adapt the previous list of substances and methods prohibited in sport, approved by Resolution of December 18, 2014 of the Presidency of the Higher Sports Council, to the list adopted within the framework of the UNESCO International Convention against Doping in Sport, this Higher Sports Council resolves to approve the list of substances and methods prohibited in sport, contained in the annexes of this resolution.
This resolution will apply to doping control procedures in sport carried out in official state competitions or, outside of them, to athletes licensed to participate in such competitions.
The previous list approved by Resolution of December 18, 2014 of the Presidency of the Higher Sports Council is repealed, while Annex II, Substances and methods prohibited in greyhounds, and Annex III, Substances and procedures prohibited in equestrian competitions, of the Resolution of December 20, 2013 of the Presidency of the Higher Sports Council, remain in force, in development of the sanctioning regime provided for in Royal Decree 255/1996, of February 16, which establishes the Regime of Infringements and Sanctions for the Repression of Doping, in force for those concerning animals.
